What you should know before reading further: California gives accident victims two years from the date of injury to file a personal injury lawsuit under Code of Civil Procedure § 335.1. The clock is shorter — just six months — for claims against a city, county, or state agency under Government Code § 911.2. Missing either deadline ends your case before it starts. Call us today for a free consultation.
Insurance companies in California settle the vast majority of personal injury claims, but they do not settle them at full value unless they have to. Our process is built around making the case impossible to defend. We document medical treatment as it happens, lock down witness statements before memories fade, retrieve traffic-control video before it cycles off the loop, and engage accident reconstruction experts on serious-injury cases.
We file in Los Angeles County Superior Court when negotiations stall. Most cases settle during discovery once the defense sees the full evidentiary record. A small percentage proceed to trial, and we prepare every case as if it will.
Three California rules shape every recovery in our cases. Pure comparative negligence under Li v. Yellow Cab Co. (1975) allows recovery even when the plaintiff is partly at fault, reducing the award by the plaintiff’s percentage of responsibility. There is no cap on non-economic damages (pain and suffering, loss of enjoyment of life) in standard personal injury cases. Medical malpractice claims fall under MICRA, which caps non-economic damages at $390,000 for injury cases and $560,000 for wrongful death as of 2024 under AB 35, with annual increases through 2034.
The cards below outline our most common case types, but our practice covers every form of personal injury under California law. We accept catastrophic injury cases, brain and spinal cord injury claims, burn injury cases, wrongful death actions, premises liability, dog bite injuries under California’s strict liability statute (Civil Code § 3342), pedestrian and bicycle injury claims, rideshare collisions, scooter cases, bus crashes (with the six-month government tort claim deadline), drunk driving cases with punitive damage exposure, product liability under strict liability and Greenman v. Yuba Power Products, and construction site injuries with third-party tort claims beyond workers’ compensation.
The Insurance Research Council has found that personal injury claimants represented by an attorney recover 3.5 times more on average than unrepresented claimants. The reason is structural. Insurance adjusters are trained to identify unrepresented claimants and offer a fraction of the case’s actual value. A serious injury case without counsel is almost always a settled case at a fraction of its worth.
We do not handle volume work or refer cases out. Every case is handled in-house, with direct attorney access and a tight focus on building each file to maximum value. Our fee is a percentage of the recovery — typically 33% before suit is filed and 40% after — and we advance all costs. You pay nothing out of pocket. There is no fee if there is no recovery.
If you or someone in your family was injured in Los Angeles County, the most important step is to get advice quickly. Evidence disappears. Witnesses move. Insurance companies build their defense the day the accident happens, and the longer you wait, the harder it becomes to hold them accountable.
